Terms of Service
Effective June 5, 2026
These Terms of Service govern your access to and use of Voxly. By creating an account or using Voxly, you agree to these terms. If you do not agree, please do not use the service.
1. Who we are
Voxly is operated by Mykyta Verba, an individual entrepreneur (FOP) registered in Ukraine, Odesa region, city of Odesa (“Voxly”, “we”, “us”, or “our”). You can reach us at nikita@voxly.ink.
2. The service
Voxly is an AI-assisted tool that helps you draft, edit, and publish posts to X (formerly Twitter). Features may change, be added, or be removed over time, and the service is provided on an “as is” and “as available” basis without any guarantee of uninterrupted operation.
3. Eligibility
You must be at least 18 years old and able to enter into a binding contract to use Voxly. By using Voxly, you represent that you meet these requirements and that all information you provide is accurate.
4. Your account
You sign in to Voxly using Google or X. You are responsible for maintaining the security of the account you use to access Voxly and for all activity that happens under your account. Notify us promptly at nikita@voxly.ink if you believe your account has been compromised.
5. Connecting your X account
To publish posts, you connect your X account and authorize Voxly to act on your behalf via the X API. By connecting X, you authorize Voxly to read your posts (to build your voice profile) and to publish content that you create or approve. You are responsible for complying with X’s Terms of Service and rules, and you can revoke Voxly’s access at any time. We are not responsible for actions taken by X, including suspension of your X account.
6. Your content
You retain all ownership of the content you create, submit, or publish through Voxly (“Your Content”). You grant us a limited, non-exclusive license to host, store, process, and transmit Your Content solely to operate and provide the service to you — including sending it to the AI and infrastructure providers described in our Privacy Policy. You represent that you have the rights to Your Content and that it does not infringe the rights of others.
7. AI-generated content
Voxly uses AI to generate and refine drafts. AI output may be inaccurate, incomplete, biased, or not original, and similar output may be generated for other users. Voxly provides drafts as a starting point — you are solely responsible for reviewing, editing, and approving any content before you publish it, and for the content once published. We make no warranty that AI output is accurate, fit for any purpose, or free of third-party rights.
8. Acceptable use
You agree not to use Voxly to:
- violate any law, or the terms or rules of X or any other connected service;
- create or publish content that is unlawful, infringing, defamatory, harassing, hateful, deceptive, or spam;
- impersonate any person or misrepresent your affiliation with anyone;
- attempt to gain unauthorized access to, disrupt, or reverse engineer the service or its infrastructure;
- scrape, resell, or abuse the service, or use it to build a competing product.
We may suspend or terminate accounts that violate this section, with or without notice.
9. Plans, billing, and payments
Voxly offers a free plan and one or more paid subscription plans. Paid plans are billed in advance on a recurring (monthly) basis and renew automatically until cancelled. Each plan includes usage limits; exceeding them may pause billable features until the next billing period or until you upgrade.
Payments are processed by Creem, which acts as our payment provider and merchant of record. By purchasing a paid plan, you also agree to Creem’s applicable terms. You authorize recurring charges to your chosen payment method until you cancel. You can cancel or manage your subscription at any time from Voxly’s billing settings; cancellation takes effect at the end of the current billing period.
We may change our prices or plan limits. We will give reasonable notice of changes that affect an active paid subscription, and changes take effect at your next renewal.
10. Refunds
Except where required by applicable law, payments are non-refundable and we do not provide refunds or credits for partial billing periods or unused features. If you believe you were charged in error, contact us at nikita@voxly.ink and we will review it in good faith.
11. Third-party services
Voxly relies on third-party services — including X, Google, our AI and search providers, and Creem — and your use of those services is also governed by their terms. We are not responsible for third-party services, and their availability or changes may affect Voxly.
12. Our intellectual property
Voxly, including its software, design, branding, and content (other than Your Content), is owned by us and protected by intellectual property laws. We grant you a limited, revocable, non-transferable right to use Voxly in accordance with these terms. You may not copy, modify, or create derivative works of the service except as expressly permitted.
13. Termination
You may stop using Voxly and delete your account at any time. We may suspend or terminate your access if you breach these terms, if required by law, or if we discontinue the service. On termination, your right to use Voxly ends; sections that by their nature should survive (such as ownership, disclaimers, and limitation of liability) will continue to apply.
14. Disclaimers
Voxly is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure, or that AI output will meet your expectations.
15. Limitation of liability
To the fullest extent permitted by law, Voxly and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or content, arising out of or related to your use of the service. Our total liability for any claim relating to the service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD 50.
16. Indemnification
You agree to indemnify and hold harmless Voxly and its operator from any claims, damages, or expenses (including reasonable legal fees) arising from Your Content, your use of the service, or your violation of these terms or the rights of any third party.
17. Governing law and disputes
These terms are governed by the laws of Ukraine, without regard to conflict-of-law rules. Any dispute arising from these terms or your use of Voxly will be subject to the jurisdiction of the competent courts of Odesa, Ukraine, unless mandatory law in your country of residence provides otherwise.
18. Changes to these terms
We may update these terms from time to time. When we make material changes, we will update the effective date above and, where appropriate, notify you. Your continued use of Voxly after a change means you accept the updated terms.
